Introduction

The Changes

Personal Data Management

UD. Hikmal Maula Fakhri collects data in the form of Full Name, Company Name, Email, Full Address, Company NPWP and Telephone Number for purposes used as user or consumer data.
UD. Hikmal Maula Fakhri collects data in the form of ID cards and Company Documents for the process or requirements for activating certain domains.
You agree that we will use your Personal Data to provide you with information related to promotions and information related to the services you use.
The retention period or storage of Personal Data is forever or until the user requests data deletion.
If the user is a minor or has a disability, then indirectly the parent or guardian concerned will agree to the provisions regarding Personal Data Management.
If a Company Acquisition occurs, you agree that your Personal Data may be provided or managed by the party receiving the Acquisition, either domestic or foreign.
You agree that UD. Hikmal Maula Fakhri is released from all forms of law relating to your Personal Data and will not undergo the trial process if it relates to your Personal Data.

The Content

All services provided by UD. Hikmal Maula Fakhri are used for lawful purposes.
Any content or links containing controversial content, sexually explicit content, or other content that may be offensive to you or users will be your responsibility.
All content or links that violate the law are not permitted, including copyright infringement, trademark, hate speech, phishing, SARA, pornography, online prostitution, human trafficking, fraud and similar violations.
Any content that may interfere with the performance of the UD. Hikmal Maula Fakhri server is not permitted.
Any script in the form of phishing will be immediately terminated.
Domains used for Phishing activities will be deleted or the domain status will be changed to Fraud.

The Data Traffic

UD. Hikmal Maula Fakhri provides data traffic according to the specified limit. If you have used data traffic beyond the specified limit, your account will be deactivated. Then, you will be advised to upgrade to a higher package or service.
UD. Hikmal Maula Fakhri is not responsible and is exempt from claims for compensation for data delivery errors or slow data traffic.

Suspension and Termination

You agree to comply with these Terms of Service. Any violation, either against the Terms of Service or other rules: regulations and policies below, which can be a reason for UD. Hikmal Maula Fakhri to suspend or terminate your account.

You agree that UD. Hikmal Maula Fakhri has the right with or without notice, to suspend or terminate your account upon the first or subsequent occurrence of any of the following:

Using the services in a manner that constitutes a violation of any applicable law, court order, tariff, regulation, or agreement (including, but not limited to, intellectual property, communications, privacy, criminal, and international laws).
Using the service in a manner intended to abuse or violate the privacy or property rights of others.
Engaging in harassment, whether through language, frequency or size of messages, whether using email or site content.
Assisting directly or indirectly in the illegal distribution of copyrighted material.
Using the service in an attempt to breach the security of any computer network (including the service itself), to access accounts, messages, or files that are not yours.
Using the service in such a way as to forge or re-present headers, addresses, or other identifiers on e-mail or websites, and using other means to disguise the identity or location of the sender. This includes proxy server hosting applications.
Uploading, linking, or storing warez, cracks, or other pirated software.
Providing false or incomplete contact details, including name, postal address and telephone number.
Using the service to run server programs, including but not limited to, mail servers, IRC servers, game servers, FTP servers, Web servers, or streaming audio/video servers.
Using the service to carry out mail bombing, including cases where several messages are sent to one destination with a specific purpose with the aim of disrupting the recipient and/or the electronic system serving the recipient.
Attempting to interfere in any way with or deny service to any user or host on the Internet.
Performing a chargeback on any past or current transaction will cause the account to be suspended until it is resolved. If a chargeback occurs, we reserve the right to terminate your account without regard to future business.
Excessive use of services in such a way as to limit the bandwidth available to others.
Using the Service to conduct a flooding attack, which is defined as the act of overloading a recipient’s computer system by sending large amounts of false data that interferes with or disables the recipient’s system’s functionality, or by other denial-of-service attack methods.
Providing false data on your registration form, contract, or online application, including providing stolen credit card or other payment information.
You agree not to access or attempt to access any private areas of the service.
You agree to notify IDCloudHost upon becoming aware of any unauthorized use of your account and/or any breach or attempted breach of the security of the Service.
UD. Hikmal Maula Fakhri is not obliged to check or view messages, files, or other content, which can be accessed through, through, or is in the service. Complaints regarding alleged copyright infringement can be sent to UD. Hikmal Maula Fakhri WhatsApp
UD. Hikmal Maula Fakhri’s server will automatically suspend all services detected as viruses, abuse, and excessive resources, UD. Hikmal Maula Fakhri does this to maintain security on the server.
If the Anti-Virus owned by IDCloudhost detects a Virus such as PHPSHELL, Trojan, PHP.HIDE, Heuristic.HTML.Dropper etc., the system will automatically suspend with Reason Virus Detected.
Regarding serious or repeated violations of service policies including DDOS, port scanning, sniffing, and system exploits, botnets/trojans and other hacking/cracking activities, IDCloudHost has the right to suspend or even terminate the service without giving prior warning to the customer.
Using and displaying services for activities such as gambling, betting, and the like and applies both in relation to the content and reference links that display the site.
Hosting accounts that experience Site Defacement will be suspended to anticipate any scripts being used for hacking actions on the hosting account.
The service will automatically suspend if there is a delay in payment after 1 day.
The service will automatically delete data on the service if the delay has exceeded 30 days.
Services that have been suspended due to late payment cannot be activated for any reason unless the user extends the payment first.

UD. Hikmal Maula Fakhri has the right to terminate the contract and terminate the service unilaterally if the customer commits bad ethics or acts that are excessively impolite / inhumane, exceeding the limits of decency or intentionally defaming the good name of UD. Hikmal Maula Fakhri in the mass media, social media, mailing lists, forums or the like and UD. Hikmal Maula Fakhri has the right to terminate the contract and terminate the service unilaterally if the customer is proven to have violated the rules and provisions of service at UD. Service Level Agreement (SLA)

Service Level Agreement (SLA) is the level of service or performance expected or promised by UD. Hikmal Maula Fakhri to customers.
SLA does not apply if the service is undergoing Internal Maintenance, including Maintenance from the Data Center and ISP, including disruptions that occur at the Data Center and ISP.
SLA does not apply if there is damage to hardware and hardware devices.

Dispute

UD. Hikmal Maula Fakhri has the right to claim damages for acts of infringement and defamation committed by customers.
Disputes between users of Reseller services and or Parties cooperating with Customers are not our responsibility, UD. Hikmal Maula Fakhri is only an intermediary between the two parties.
You agree that any dispute between you and UD. Hikmal Maula Fakhri arising from your use of the service in any way based on your bond as a customer, and/or use of the service can be resolved without first going through legal channels.

Suspend/Unsuspend Terms

UD. Hikmal Maula Fakhri will suspend your account if it violates the Terms of Service and UD. Hikmal Maula Fakhri will not provide prior notification after UD. Hikmal Maula Fakhri suspends it. UD. Hikmal Maula Fakhri will unsuspend if you are willing to follow the orders/regulations given by UD. Hikmal Maula Fakhri.

UD. Hikmal Maula Fakhri will unsuspended only if you have contacted UD. Hikmal Maula Fakhri and UD. Hikmal Maula Fakhri will inform you for the handling.
The service will automatically suspend if there is a delay in payment after 1 day.
The service will automatically delete data on the service if the delay has exceeded 35 days.
Services that have been suspended due to late payment cannot be activated for any reason unless the user extends the payment first.

Terms of Use

General Domain Policy

We make no representation that the domain name you wish to register can be registered by you or for you or registered in your name. You should not assume that the domain name you request has been registered until you are notified otherwise.
Registration and use of your domain name is subject to the Terms of Service of use imposed by the competent naming authority; ICANN for International TLDs and PANDI for Indonesian TLDs.
You are not entitled to file a claim with us regarding the rejection of domain name registration. Any administration fees you pay to register your desired name are non-refundable even if the rejection is made by the naming authority.
We are not responsible for your use of any domain name; any dispute between you and any other person must be resolved between the parties concerned in the matter. If such a dispute arises, we reserve the right at our discretion and without giving any reason whatsoever to withhold, suspend or cancel the domain name. We also reserve the right to make representations to the relevant naming authority, but will not be required to take part in any such dispute.
We will not release a domain to another provider unless we have not received full payment for the domain. All fees payable by you for services shall be in accordance with the fees and rates published from time to time on our site and shall be due and payable at the commencement of our provision of the services.
You are fully responsible for the domain used and we are released from all claims related to misuse and/or the domain used and PANDI as the domain center is free from claims related to the domain used.
UD. Hikmal Maula Fakhri has the right to suspend and terminate domains that contain content that violates the TOS provisions of IDCloudHost or violates Indonesian laws (eg: Pornography, Online Gambling, Phishing, and others).
For accounts or users who are proven to have carried out phishing on 3 domains, all domains active on the user’s service will be suspended.
UD. Hikmal Maula Fakhri has the right to suspend and terminate domains that contain content that violates the provisions of UD. Hikmal Maula Fakhri’s TOS (eg: pornography, online gambling, phishing, and others).

Domain Name Registration Policy

Domain Names that have been purchased and are active by customers cannot be replaced or changed with another domain name. If customers want to change the domain name, then customers must purchase a new domain.
UD. Hikmal Maula Fakhri is not responsible for domain names that have been purchased by other customers and or have been purchased by other parties.
Customers are fully responsible for the WHOIS information provided by themselves. Customers are prohibited from misusing ‘Owner/Registrant Contact’, ‘Administrative Contact’ and ‘Billing Contact’, for example using other people’s names and addresses without permission from the relevant party.
Any costs or losses incurred by third parties, such as Domain Registrar (the company where the customer’s domain name is registered) are the customer’s obligation, NOT the obligation of UD. Hikmal Maula Fakhri.
Domain activation is carried out after payment is made and for domains that require requirements, it is mandatory to send the specified requirements so that after that the domain activation can be carried out.

Domain Name Transfer Policy

Domains that can be transferred are domains that are at least 90 days old since they were activated.
UD. Hikmal Maula Fakhri is not responsible for domain transfer errors made by customers.
Specifically for Indonesian domains, customers are requested to re-attach the Indonesian domain requirements via ticket as a condition for activating the Indonesian domain service.
UD. Hikmal Maula Fakhri is not responsible for the failed transfer process due to rejection from the previous domain provider.

Domain Name Renewal Policy

Customers can create reminders and extend domains independently because it is the customer’s responsibility to determine the activation of domain service extensions. UD. Hikmal Maula Fakhri is not responsible for domain loss that occurs due to customer negligence due to not extending the domain at the specified time.
After the domain expires, the domain will enter the “Redemption Period”, where customers who want to renew the domain will likely be charged a domain redemption fee of up to 30 times for Indonesian domains and 20 times for international domains. For this redemption fee, please confirm via WhatsApp to UD. Hikmal Maula Fakhri because each domain extension (TLD) has a different price.
During the “Redemption Period”, the domain can be auctioned, sold or transferred to a third party by the Registrar. UD. Hikmal Maula Fakhri cannot prevent this or return a domain that has been taken over by a third party.
UD. Hikmal Maula Fakhri is not responsible for returning domains that have been processed for renewal payments, but there was a system failure that caused the domain not to be renewed and the customer as the domain owner did not contact UD. Hikmal Maula Fakhri to carry out manual domain renewal so that the domain was finally taken over by a third party.
UD. Hikmal Maula Fakhri will refund all fees paid by customers if the system fails to renew which causes the domain to be owned by a third party.
Customers are prohibited from replacing ‘Owner/Registrant Contact’, ‘Administrative Contact’ and ‘Billing Contact’ with the name and email address of UD. Hikmal Maula Fakhri, because announcements such as domain extensions and so on will be sent to that address (to customers).
Renewing the domain name is entirely the customer’s own responsibility, the customer is not entitled to use the name and email address of UD. Hikmal Maula Fakhri on the contact and charge the extension of the domain name to UD. Hikmal Maula Fakhri.
In accordance with the ICANN Domain Registry regulations – the manager of all domain names in the world, if your domain name has expired/mature, the Registrar (ICANN Reseller) will return your domain name to the Registry so that your domain status changes to ‘REDEMPTION PERIOD’. The registry will hold the domain name until it is released/available. During this period, UD. Hikmal Maula Fakhri cannot help you extend it. Monitoring the domain name until it is released/available again is NOT the responsibility of UD. Hikmal Maula Fakhri.

WordPress Hosting Service Policy

WordPress Hosting service only gets WordPress Panel without being able to create FTP, email and subdomain. Customers can contact UD. Hikmal Maula Fakhri for this and customers will also be charged additional fees for the service.

Payment Policy

Payment and Fee Policy

Payment of service fees is made through the payment methods provided.
Without any obligation from UD. Hikmal Maula Fakhri to provide notification, UD. Hikmal Maula Fakhri has the right to suspend and/or stop the provision of services and without prejudice to other rights of UD. Hikmal Maula Fakhri if the service recipient does not immediately make payment of the bill when due.
Transactions using the Paypal method will be subject to an admin fee of 9% of the total transaction.
Every transaction using the Payment Gateway will be subject to a Service Cost (fee). Service Cost is a fee added to the bill or invoice for each transaction by the payment gateway outside of the main transaction. The value of the Service Cost differs for each transaction depending on the payment gateway method used and the value of each transaction.
Each transaction will be subject to a Service Fee. Service Fee is a fee added to the bill or invoice for each service transaction with a certain value. This fee is allocated for Operational activities, Network Protection, Customer Service and Maintenance.
Payments using the Bank transfer method made between 21:00 – 07:59 WIB will be processed at 08:00 WIB, because at that time several banks are performing maintenance so that payments will be processed after we receive payment verification or transaction updates from the Bank.

Refund Policy

All transactions on UD. Hikmal Maula Fakhri services can be refunded only under certain conditions such as nominal errors in transactions, please contact UD. Hikmal Maula Fakhri to ask about this.
Customer agrees and will not sue UD. Hikmal Maula Fakhri when rejecting a refund request for any reason.
Transactions via E-Wallet (Gopay, Ovo, Dana, etc.) can be refunded with a deduction of a certain nominal amount according to the policy of the party concerned.
The decision to refund or refund will result in your service being deleted or terminated.
Refunds can be sent to the sender’s account and cannot be refunded to anyone other than the owner of the sender’s account. Customers who wish to make a refund to an account different from the sender’s account must include proof of previous delivery.
